The Uncontested Divorce Process

Step 1

Initial Review and
Discussion of Goals

The client will meet with the attorney to review the current status of the case, develop a plan of action, determine a budget, and formulate a timetable for resolution. The attorney will discuss the client’s specific goals, review any relevant caselaw or statutes and answer the clients questions about the process.

Step 2

Negotiations

Negotiating a divorce settlement typically requires exchanges of proposals from the respective sides. We can assist you in the negotiation of any terms that are necessary to arrive at an agreement with your spouse. If the matter is totally uncontested, the client can provide us with their proposed “agreement in principle” that we will use to draft a comprehensive marital settlement agreement.

Step 3

Document Drafting

This stage includes preparation of all documents necessary to complete your uncontested divorce including a marital settlement agreement, Complaint for divorce, supporting affidavit,, service of process documents, and court record forms.

Step 4

Filing and Entry of
Final Decree of Divorce

Once all documents have been drafted, we will file them with the court and take any further actions that are necessary to obtain entry of a final decree of divorce.
